Terms of Service

Sygic Travel API, Sygic Travel SDK and Sygic Travel Trip Planner (collectively, "Sygic Travel B2B Services") are operated by Tripomatic s.r.o. t/a Sygic Travel ("Sygic Travel", "we" or “us”). By using Sygic Travel B2B Services or data content we make available to you through Sygic Travel B2B Services, you agree to be bound by the following Terms of Service, as updated from time to time (collectively, the "Terms"). If you do not agree to all the Terms, do not use Sygic Travel B2B Services.

Licence

Subject to these Terms, we grant you a non-exclusive, revocable license and right to use Sygic Travel B2B Services in online services and online, desktop, or mobile applications. You may use Sygic Travel B2B Services for both non-commercial and commercial purposes.

When using Sygic Travel B2B Services, you cannot grant sublicense rights to any third party. You cannot resell the data from Sygic Travel B2B Services or provide the data to third parties.

Payment

When using Sygic Travel B2B Services, you agree to pay the charges for the selected package or product. If you exceed the number of requests to the API or number of monthly active users included in your package, we may charge you excess fees at the end of the billing period or charge you the fees for the package that complies with the number of API requests or monthly active users. You agree to pay such fees for all usage.

Sygic Travel will issue an invoice for using Sygic Travel B2B Services once a month.

If you earn affiliate commissions from travel products that Sygic Travel shall pay out to you, the price for using Sygic Travel B2B Services can be deducted from such commission.

Account cancellation or suspension

Cancellation is possible at any time. However, in case you cancel before the end of a billing period, you will not be refunded for the unused time of your subscription.

In case you breach any of these Terms, the license granted by this agreement terminates automatically, without notice to you.

Caching

You may cache data from Sygic Travel API on end-user devices (e.g. computers, smartphones and tablets) for offline use, but each device must populate its cache using direct requests to Sygic Travel API and content from a cache may only be consumed by a single end user. You may not redistribute the data from Sygic Travel B2B Services, including from a cache. You may not scrape or download data from Sygic Travel API and Sygic Travel SDK in bulk for any purpose other than offline caching on a single end user’s device.

Third-party Suppliers

Sygic Travel B2B Services may contain links related to other products, such as tours and activities, air tickets or hotel bookings, provided by external suppliers. If you choose to display these travel products, you must meet the conditions set by products suppliers.

You cannot not use or display (directly or indirectly) the trademark, logo or branding (including, without limitation, any misspelling or substantially similar version thereof) of the suppliers and/or their product suppliers, in any manner whatsoever (including without limitation, in any search engine marketing or optimization, in any domain name, any other online/offline marketing or advertising, press releases, etc.) without first obtaining prior written approval from the supplier, which may be denied in the supplier's sole discretion.

You cannot bid on the terms using the name of the product supplier including misspellings and substantially similar versions in pay per click advertising.

Publicity

We are happy that you have decided to use our services. During the term of this agreement, you hereby grant us a worldwide, non-exclusive, royalty-free, non-transferable license to use your trademarks, service marks, and logos for the purpose of identifying you as a Sygic Travel customer to promote and market our services. However, if you prefer not to be mentioned as our customer, let us know, we will respect that.

Miscellaneous

You may not use Sygic Travel B2B Services in any manner that could damage or overburden Sygic Travel B2B Services or interfere with any other party's use.

You cannot use Sygic Travel B2B Services only to get access to 360° videos available in the Sygic Travel API, unless you have our written consent.

You cannot bid on the terms Sygic Travel, Sygic, Tripomatic including misspellings and substantially similar versions in pay per click advertising.

You must provide attribution to Sygic Travel data suppliers and Sygic Travel as described in the documentation.

You may not modify, reverse engineer, decompile or disassemble Sygic Travel B2B Services.

Limitation of liability

Under no circumstances shall Sygic Travel or its affiliate, employees or third party partners or suppliers be liable for any damages (including loss of profits, data or use or cost of cover) arising out of the use or the inability to use Sygic Travel B2B Services.

To the fullest extent permissible pursuant to applicable law, in no event will Sygic Travel, its licensors and suppliers, or agents or employees of any of the foregoing, be liable for any decision made or action taken by you or anyone else in reliance on the information provided by the Sygic Travel B2B Services. You are responsible for the entire risk arising out of your use of Sygic Travel B2B Services.

Sygic Travel shall not be liable for any direct or indirect damage caused by third-party suppliers such as incorrect content, technical failures etc.

Disclaimers

Sygic Travel does not provide any warranties of content accuracy. The content is provided on "AS IS", "AS AVAILABLE", "WITH ALL FAULTS" basis.

Sygic Travel B2B Services may contain links to third party websites. Sygic Travel is not responsible for the accuracy, availability or reliability of any information, goods, data, opinions, advice or statements made available on third party websites that you access from the Sygic Travel B2B Services. Sygic Travel is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any third party website.

Indemnification

You agree to indemnify and hold harmless Sygic Travel and its subsidiaries, affiliates, officers, agents, partners, and employees from any claim or demand, including reasonable attorneys' fees, arising out of:

Changes to services or terms

These Terms and other terms related to your use of Sygic Travel B2B Services may be modified by us in time by posting the updated terms on the site. All changes will take effect immediately upon posting to the site unless a later date is specified. Changes will not apply retroactively. You are advised to check these Terms periodically to keep track of changes - your continued use of Sygic Travel B2B Services after new terms become effective constitutes your binding acceptance of the new terms.

The features and functions of Sygic Travel B2B services, including API, may be changed in time. It is your responsibility to ensure that calls or requests you makes to Sygic Travel B2B Services are compatible with then-current Sygic Travel API. We do our best to avoid changes to our API that are not backwards compatible, but occasionally they may become necessary. Should that happen, we will use reasonable efforts to notify you prior to deploying the changes.
